The Icelandic Commonwealth (Þjóðveldið) is the modern term used for the period of Icelandic history between the Althing’s establishment in 930 to the island’s submission to Norway in 1262. These centuries of independence were made possible by Iceland’s unique political and legal systems. While the organization of the goðar avoided the consolidation of power to a single person, Icelandic law provided the structure by which society avoided anarchy. Our major source for these legal codes comes from the quaintly named Grágás (“Grey Goose”) collection of 13th century laws, which contains chapters on everything from land ownership and assembly procedure to homicide.
The importance of the legal system is heavily explored in the family sagas, whose narratives center around what can happen if the law fails to rein in conflict – problems fester, leading to feuds and killings or, in extreme cases, the burning of longhouses with families inside. Yet all sagas witness the characters returning to the law in the end, implementing the code to resolve the conflict and demonstrating the faith in which the Icelandic people had in the system.
