The power of the Norman dukes was passed down through practiced custom rather than written law, an oral preservation of authority that was fragile in the face of political change. When Robert Curthose, William the Conqueror’s eldest son, prepared to embark on the First Crusade in 1096, he sought a regent to oversee Normandy in his absence. His younger brother William Rufus, King of England, paid 10,000 silver marks for the responsibility, but he was less familiar with the customary rights of Norman rulers. To ensure a smooth transition, Robert and William commissioned an inquest to establish these rights in writing. The barons and bishops of Normandy convened at Caen to record their knowledge in a text now known as “Consuetudines et Justicie” (“Customs and Justice”), providing an unusual snapshot of the responsibilities and limitations of power established by the Conqueror himself.
