The first documented case of what came to be called privateering was in England in 1243 when King Henry III issued licenses allowing privately-owned vessels to capture loot from enemies at sea, provided they share it with the Crown. These letters of marque, as they came to be called, originally granted private shipowners the right to enact vengeance on foreign actors regardless of formal war status, but over time, became a tool in the arsenal of a state’s war-making capacity. In the 16th century, the practice had become a commonplace throughout Europe and was a significant component of the period’s efforts to harness the sea, especially by the British. Famous sailors like Sir Francis Drake and Sir Walter Raleigh raided the Caribbean and the Spanish coast, capturing treasure fleets sailing from the New World. When the war against the Spanish ended and privateers were no longer sanctioned by the state, many continued their raiding but as pirates.
As the Industrial Revolution changed the landscape of war and of violence, privateering was no longer useful to the state. Throughout the 19th century, European nations outlawed the practice; the last known case of state-sanctioned privateering in Europe was during the Franco-Prussian War when Prussia formed a navy of privately-owned ships. Although European nations agreed to end privateering, the ability to issue letters of marque remains a power of the United States Congress. Throughout the 21st century, various proposals have been presented to resurrect the practice as a potential solution to modern pirating, drug trafficking, and terrorism.
